Terms of Use

These Terms of Use (“Terms”) govern your use of this website operated by Manoir de Soie (“Company”, “we”, “us”, “our”), a business registered in Seoul, Republic of Korea.
By accessing or using this website or purchasing products through it, you agree to be bound by these Terms and by all applicable laws of the Republic of Korea.

Terms and Conditions
Article 1 (Purpose)
These Terms and Conditions set forth the rights, obligations, and responsibilities between Manoir de Soie (the “Company”), which operates the Manoir de Soie online store (hereinafter referred to as the “Mall”), and users regarding the use of internet-based services (the “Services”) provided through the Mall.
※ These Terms shall also apply, to the extent not contrary to their nature, to electronic commerce conducted through mobile or other communication networks.
Article 2 (Definitions)

“Mall” refers to the virtual business premises operated by Manoir de Soie to allow users to trade goods or services (“Products”) via computers or other information and communication devices, and also refers to the business entity that operates the online store.

“User” means a person who accesses the Mall and receives services provided by the Mall in accordance with these Terms, including both members and non-members.

“Member” means a person who has registered as a member of the Mall and can continuously use the services provided by the Mall.

“Non-member” means a person who uses the services of the Mall without registering as a member.
Article 3 (Posting, Explanation, and Amendment of Terms and Conditions)

The Mall shall post these Terms, the company name, representative’s name, business address (including the address where consumer complaints can be handled), telephone number, fax number, email address, business registration number, e-commerce registration number, and the personal information protection officer’s contact information on the Mall’s homepage so that users can easily access them.

Before a user agrees to these Terms, the Mall shall provide a separate screen or pop-up to ensure the user clearly understands key provisions such as withdrawal of offers, delivery responsibility, and refund conditions.

The Mall may amend these Terms to the extent not violating applicable laws such as the Act on Consumer Protection in Electronic Commerce, the Regulation of Standardized Contracts Act, the Electronic Documents and Transactions Act, and other related laws.

In the event of amendment, the Mall shall specify the effective date and reason for amendment and post both the current and revised Terms on the homepage from at least 7 days prior to the effective date until the day before implementation. If the changes are unfavorable to users, the notice period shall be at least 30 days. The Mall shall clearly display a comparison between the old and new Terms for clarity.

The amended Terms apply only to contracts concluded after the effective date. Contracts concluded before that date remain governed by the previous Terms, unless the user agrees to apply the revised Terms within the notification period.

Any matters not stipulated in these Terms shall be governed by applicable laws or general commercial practices.
Article 4 (Provision and Modification of Services)

The Mall provides the following services:

Information on products and facilitation of purchase contracts

Delivery of purchased products
-
Other services designated by the Mall

If a product becomes unavailable or specifications change, the Mall may modify future offerings. In such cases, the changes and the effective date shall be promptly announced on the page displaying the original product information.

If the Mall must change a contracted service due to product shortages or technical issues, the Mall shall immediately notify the user at the provided contact address.
-
The Mall shall compensate users for damages caused by such changes, except where the Mall proves absence of intent or negligence.
Article 5 (Service Interruption)

The Mall may temporarily suspend services due to system maintenance, replacement, malfunction, or communication failures.

The Mall shall compensate users or third parties for damages caused by such interruptions unless the Mall proves the absence of intent or negligence.

If the Mall permanently discontinues its services due to business closure, merger, or transition, users shall be notified as specified in Article 8, and compensation shall be provided according to previously announced standards or in equivalent goods or cash.
Article 6 (Membership Registration)

Users apply for membership by completing the registration form and agreeing to these Terms.

The Mall shall approve membership applications unless:

The applicant was previously disqualified under Article 7(3) (except where reapproved after 3 years),
-
The registration contains false or incomplete information, or
-
The Mall deems the application technically problematic.

Membership takes effect when the Mall’s approval notice reaches the applicant.
-
Members must promptly update any changes to their information through the Mall.
Article 7 (Withdrawal and Loss of Membership)

Members may request withdrawal at any time, and the Mall shall process it immediately.

The Mall may restrict or suspend membership if:

False information was provided at registration,
-
Payment obligations are not fulfilled on time,
-
Another person’s account or information is misused,
-
The member violates laws, these Terms, or public order and morals.
-

If the same conduct is repeated twice or remains uncorrected within 30 days, the Mall may revoke membership.
-
In case of revocation, the Mall shall notify the member and provide at least 30 days to explain before deletion.
Article 8 (Notice to Members)

Notices to members shall be sent to the email address specified in advance by the member.

General notices may be posted on the Mall’s notice board for one week instead of individual notification, except when the matter materially affects a specific member’s transaction.
Article 9 (Purchase Application and Consent to Provide Personal Information)

Users apply to purchase goods by following these or similar steps:

Search and select product

Enter recipient’s name, address, contact info, and email
-
Confirm important terms (e.g., withdrawal rights, shipping fees)
-
Agree to these Terms and confirm purchase
-
Submit order and confirm acknowledgment
-
Select payment method
-

If the Mall must provide buyer information to a third party, it shall inform and obtain consent on the recipient, purpose, items shared, and retention period.

If the Mall outsources processing of personal data, it shall notify the buyer and obtain consent unless the processing is necessary for service fulfillment and disclosed in the Privacy Policy.
Article 10 (Formation of Contract)

The Mall may refuse to accept an order if:

Information is false or incomplete,
-
The buyer is a minor purchasing restricted items (e.g., alcohol),
-
Technical limitations prevent processing.
-

The contract is deemed concluded when the user receives the order confirmation notice.
-
The confirmation includes order details, availability, and modification/cancellation guidance.
Article 11 (Payment Methods)
Payment may be made by any of the following methods:

Bank transfer (internet/phone/mail banking)
-
Credit/debit/prepaid card payment
-
Direct bank deposit
-
Electronic money
-
Cash on delivery
-
Points or mileage
-
Gift certificates approved by the Mall
-
Other electronic payment methods
No additional fees shall be charged for payment method selection.
Article 12 (Acknowledgment of Receipt, Changes, and Cancellation of Purchase Applications)

When a user submits a purchase application, the “Mall” shall send the user a confirmation of receipt.
-
The user who receives the confirmation of receipt may request changes or cancellation of the purchase application immediately if there is any discrepancy in their intent. The “Mall” shall promptly process the request before delivery. However, if the payment has already been made, Article 15 on withdrawal of subscription applies.
Article 13 (Supply of Goods, etc.)

Unless otherwise agreed upon regarding the timing of delivery, the “Mall” shall take necessary measures such as order preparation and packaging to deliver goods within 7 days from the day the user submits a subscription. If the “Mall” has already received all or part of the payment, it shall take action within 3 business days from the date of receipt. The “Mall” shall allow users to check the procedures and status of delivery appropriately.

The “Mall” shall specify the delivery method, shipping costs, and delivery period. If the agreed delivery period is exceeded, the “Mall” shall compensate the user for any damages caused, unless the “Mall” proves no negligence or intentional wrongdoing.
Article 14 (Refunds)
If the goods ordered by the user are out of stock or cannot be supplied, the “Mall” shall immediately notify the user and refund any payments received within 3 business days or take necessary measures for the refund.
Article 15 (Withdrawal of Subscription, etc.)

Users who have entered into a purchase contract with the “Mall” may withdraw their subscription within 7 days from the day they receive the written information on the contract, as provided under Article 13(2) of the 「Act on Consumer Protection in Electronic Commerce」. If delivery is delayed, the period starts from the day the goods are received or the delivery begins. Other laws regarding withdrawal apply where stipulated.

After receiving the goods, users cannot request a return or exchange in the following cases:

The goods are damaged or lost due to the user’s responsibility (except if the packaging was opened only for inspection).
-
The value of the goods is significantly reduced due to use or partial consumption by the user.
-
The value of the goods has significantly decreased over time, making resale difficult.
-
If identical goods can be replicated, and the original packaging is damaged.
-

If the “Mall” has not clearly stated the restrictions on withdrawal or provided trial products, the user’s right to withdraw cannot be restricted.
-
Regardless of the above, if the goods differ from the description or the contract, the user may withdraw within 3 months from receipt or 30 days from the date of awareness.
Article 16 (Effects of Withdrawal, etc.)

When the “Mall” receives returned goods, it shall refund the payment within 3 business days. If the refund is delayed, the “Mall” shall pay interest calculated according to the delay interest rate set in the Enforcement Decree of the 「Act on Consumer Protection in Electronic Commerce」.

If the payment was made via credit card or electronic money, the “Mall” shall immediately request the payment service provider to suspend or cancel the payment.
-
Costs for returning goods due to withdrawal shall be borne by the user, except in cases where the goods differ from the description or contract; in such cases, the “Mall” bears the cost.
-
If the user paid for shipping, the “Mall” shall clearly indicate who bears the shipping costs upon withdrawal.
Article 17 (Protection of Personal Information)

The “Mall” collects only the minimum personal information necessary to provide services.
-
The “Mall” does not collect information in advance for purchase contracts, except where legally required for identity verification.
-
The “Mall” shall notify the user of the purpose of collection and obtain consent when collecting personal information.
-
The “Mall” shall not use collected personal information for purposes other than the stated purpose; if a new purpose arises or information is shared with third parties, the user shall be notified and consent obtained.
-
The “Mall” must provide information on the personal information manager, collection and use purposes, third-party sharing details, etc., as required by law. Users may withdraw consent at any time.
-
Users can access and request correction of their personal information, and the “Mall” must act promptly.
-
The “Mall” limits access to personal information and is responsible for any loss, theft, leakage, or unauthorized use.
-
Personal information shall be destroyed promptly once the purpose is fulfilled.
-
Consent for personal information collection shall not be pre-checked, and refusal shall not restrict service, except for essential items.
Article 18 (Obligations of the “Mall”)

The “Mall” shall not engage in prohibited acts and must provide goods and services continuously and stably.

The “Mall” shall maintain security systems to protect users’ personal and credit information.
-
The “Mall” is responsible for compensating users for damages caused by unfair advertising under the 「Fair Labeling and Advertising Act」.
-
The “Mall” shall not send unsolicited commercial emails.
Article 19 (Member ID and Password Obligations)

Except as stated in Article 17, users are responsible for managing their ID and password.
-
Users must not allow third parties to use their ID or password.
-
If users discover their ID/password is stolen or misused, they must notify the “Mall” immediately and follow instructions.
Article 20 (User Obligations)
Users shall not:

Register false information or make unauthorized changes.
-
Use others’ information.
-
Alter information posted by the “Mall.”
-
Transmit or post programs or information other than allowed.
-
Infringe on copyrights or intellectual property of the “Mall” or third parties.
-
Damage reputation or disturb business operations of the “Mall” or third parties.
-
Post obscene, violent, or otherwise illegal content.
Article 21 (Relationship Between Connected Malls)

When a mall is linked to another via hyperlink, the linking mall is the “connecting mall,” and the linked mall is the “connected mall.”
-
The connecting mall is not responsible for transactions between the user and the connected mall, if it clearly states this on the initial or popup screen.
Article 22 (Copyrights and Use Restrictions)

Copyright and intellectual property of materials created by the “Mall” belong to the “Mall.”
-
Users must not reproduce, distribute, publish, or commercially use information owned by the “Mall” without prior consent.
-
If using user-generated content as agreed, the “Mall” must notify the user.
Article 23 (Dispute Resolution)
-
The “Mall” shall establish a compensation mechanism to handle users’ complaints and claims.
-
Complaints shall be prioritized; if prompt handling is difficult, the user shall be informed of the reason and schedule.
-
Users may seek dispute resolution via the Fair Trade Commission or dispute mediation agencies designated by local governments.
Article 24 (Jurisdiction and Governing Law)

Lawsuits regarding e-commerce disputes between the “Mall” and users shall be under the jurisdiction of the user’s address at the time of filing. If no address, the court of residence applies. For unknown addresses or foreign residents, the court under the Civil Procedure Act applies.

Korean law governs disputes between the “Mall” and users.
